Proposed Amendments to the Buffer Regulations

The Commission will consider these draft regulations at its May 1, 2013 meeting for publication in the Maryland Register as proposed regulations.

The draft contains amendments to COMAR 27.01.09.01, Buffer Regulations. The purpose of the amendments is outlined below.

  1. Include lots in a mapped Buffer Modification Area as needing to submit a Buffer Management Plan and Buffer Notification Form at the time of application to MDE for a shore erosion control permit.
  2. Clarify the provisions pertaining to the 200-foot Buffer and the requirement for an expanded Buffer to that buffer.
  3. Edit certain sections to eliminate redundancy in the text.

All of the proposed amendments will not lessen or increase the current requirements.

It includes lots of information about the importance of the Critical Area Buffer and includes Buffer Management Plans that can be used to satisfy Buffer planting requirements for new construction on waterfront lots.
